By accessing or using Rate My Rental, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services. Rate My Rental reserves the right to update or change these Terms at any time.
2. User Eligibility
You must be at least 18 years old to create an account or use our services.
By registering, you confirm that all information provided is accurate and truthful.
3. User Accounts
Renters: Can create a free basic account with limited access to property reviews and the ability to leave reviews.
Premium Subscriptions: Enhanced features are available for both renters and landlords. Subscription fees are non-refundable unless required by law.
Landlords and Property Managers: Must create a separate account to access certain features, such as responding to reviews.
4. Reviews and Content Posting
Renter Reviews: Renters are encouraged to provide honest and unbiased reviews of their rental experiences. All reviews must comply with our Content Guidelines.
Landlord Responses: Landlords may respond to reviews under the condition that they do so professionally and without retaliating against renters. Any retaliation, including negative consequences to renters based on their reviews, is strictly prohibited and will result in account termination.
Right to Moderate Reviews: Rate My Rental reserves the right to moderate and monitor all reviews submitted to the platform. This includes the right to remove, edit, or refuse to post any review that, in our sole discretion:
Violates these Terms.
Contains threatening, harassing, or derogatory language.
Contains content that is defamatory or at risk of defamation.
Is deemed inappropriate, irrelevant, or harmful to the community.
We reserve the right to remove or edit any content that violates our policies or local laws.
5. No Retaliation Policy
Landlords and property management companies that advertise on or use the platform must agree to our No Retaliation Policy. This means they cannot take any negative action against a renter based on their review or interaction with the platform.
Violation of this policy may lead to the suspension or termination of the landlord's account.
6. Subscription and Fees
Renters and Landlords/ Property Managers may opt for a premium membership to gain access to full reviews and additional features.
Subscription fees are billed automatically at the start of each billing cycle and are non-refundable, except as required by applicable law.
We reserve the right to change our pricing or subscription structure. Subscribers will be notified of any changes in advance.
7. Advertising
Rate My Rental offers advertising packages to landlords and property management companies starting at $100/month. Advertising space is sold on a first-come, first-served basis, and all advertisers must adhere to our Advertising Policy.
Advertisers agree that they will not retaliate against users based on reviews and understand that reviews cannot be altered by advertising or sponsorship agreements.
8. Intellectual Property
All content on the platform, including but not limited to logos, site design, and text, is the intellectual property of Rate My Rental. You may not reproduce, modify, or distribute any content from the site without prior written consent.
9. User Conduct
You agree to use the platform responsibly and not engage in any fraudulent or harmful activities, including but not limited to:
Posting false or misleading reviews.
Attempting to manipulate the system, reviews, or ratings.
Spamming, harassment, or any illegal activities.
10. Limitation of Liability
Rate My Rental is not responsible for any direct, indirect, incidental, or consequential damages that result from the use of, or inability to use, the platform.
We do not guarantee the accuracy or reliability of any user-generated content on the platform, including reviews and ratings.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or otherwise misuse the platform.
Users can terminate their own accounts at any time by contacting customer support.
12. Dispute Resolution
In the event of a dispute arising out of or relating to these Terms, you agree to resolve such disputes through binding arbitration in accordance with Arizona laws.
13. Arbitration Clause
By using Rate My Rental, you agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, including any disputes relating to the validity, interpretation, breach, or termination thereof, will be settled exclusively by binding arbitration.
Key Terms of Arbitration:
Binding Arbitration: The arbitration will be conducted in accordance with the applicable rules and laws of Arizona.
Waiver of Class Actions: You agree to resolve any disputes on an individual basis, and you waive the right to participate in any class action lawsuit or class-wide arbitration against Rate My Rental.
Arbitration Procedures: Arbitration will be conducted by a neutral arbitrator. The arbitration will be confidential, and the arbitrator's decision will be final and binding, with judgment rendered in any court having competent jurisdiction.
Costs of Arbitration: Each party will be responsible for its own costs and legal fees associated with the arbitration. However, Rate My Rental agrees to cover the costs of the arbitration itself unless the arbitrator finds the claims to be frivolous or in bad faith.
Small Claims Court Option: If the dispute is within the jurisdiction of small claims court, either party may opt to bring the dispute in small claims court instead of arbitration.
Governing Law: The arbitration will be governed by the laws of Arizona without regard to its conflict of law principles.
Exceptions to Arbitration: Both parties retain the right to seek injunctive relief for any claim involving the infringement or misappropriation of intellectual property rights.
Opt-Out Clause: You have the right to opt out of this arbitration clause within 30 days of accepting these Terms by notifying us in writing at myhomereviewsnow@gmail.com.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Arizona, without regard to its conflict of law principles.
15. Refund Policy
Subscription Cancellation
Monthly Subscriptions: You may cancel your monthly subscription at any time. Your cancellation will be effective at the end of your current billing cycle, and you will not be billed for the following month. Access to premium features will continue until the current billing cycle ends.
Annual Subscriptions: Annual subscriptions can also be canceled at any time, and your cancellation will be effective at the end of your current annual term. No partial refunds will be issued for any unused portion of the annual subscription, except as required by law.
Refund Policy for Subscriptions
Arizona Law Compliance: In compliance with Arizona Revised Statutes (A.R.S. §44-1373), we provide a 3-day cooling-off period for refunds. This means that if you purchase a subscription and request a refund within 3 business days of the initial purchase, we will issue a full refund.
Exclusions: The cooling-off period applies only to new subscriptions and does not apply to renewals.
Prorated Refunds: Refunds for annual subscriptions after the 3-day cooling-off period are not available unless the service is terminated due to non-compliance or failure to deliver the advertised services. In such cases, prorated refunds may be issued for the remaining unused portion of the subscription.
How to Cancel or Request a Refund
To cancel your subscription, log in to your account and navigate to the "Subscription" section under account settings.
If you are requesting a refund within the 3-day cooling-off period or believe you are eligible for a prorated refund, please contact our customer support team at myhomereviewsnow@gmail.com.
Automatic Renewals
Your subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. By agreeing to these terms, you authorize us to charge the payment method on file for the renewal amount.
Special Circumstances
We reserve the right to issue refunds or credits at our sole discretion in certain situations, such as technical issues or service disruptions. All refund decisions are final.
